Kenyan High Court Eldoret rules in favour of Earthbanc AB

Earthbanc AB defeats legal claims brought by Kenyan contractor Green Planet Initiative 2050 Foundation

Eldoret, 30th April, 2026 – The High Court at Eldoret, Kenya, has dismissed claims brought in 2025 by former subcontractor, plaintiff, Green Planet Initiative (GPI) 2050 Foundation. The plaintiff had advanced various legal complaints relating to its former role in Earthbanc’s Regeneration Kenya Project.

Ruling in favour of Earthbanc AB and its Kenya subsidiary Earthtree Company Limited, the court rejected and denied each and every one of the pleadings and reliefs that had been sought by the plaintiff. The court ordered the plaintiff to pay the defendants’ costs.

In its decision, the court described the plaintiff’s suit as lacking “merit, legal foundation and substance on the face of it…”

Finding favourably for Earthbanc in Kenya, the court was also highly critical of the plaintiff’s conduct and accountability failures as a former implementing partner. The court stated that “a party who fails to perform his or her side of the bargain cannot enforce the contract against the other party.”

A positive outcome for Earthbanc GPI2050

The plaintiff, GPI, had been contracted to support the implementation of the Regeneration Kenya project. The contractual relationship was terminated in April 2025 following internal reviews that indicated GPI was not meeting agreed compliance, operational and quality benchmarks. As reflected in the court record, the plaintiff confirmed that there are no amounts due or owing from Earthbanc AB.

About Earthtree Kenya

Earthtree Company Limited is Earthbanc AB’s Kenya subsidiary. As Earthbanc’s Kenya project lead, Earthtree was focused on delivering agroforestry and agriculture services across Kenya and greater Africa.

The project’s aim was to enable farmers to access support for planting trees and crops on their farm that scale up climate action with real and measurable social and environmental benefits.

Earthtree Company Limited plans, designs and supports the development of agroforestry systems, regenerative horticulture and agriculture projects. We support communities on the front line of climate change and engage with farmers, landholders and stakeholders. Our focus remains on responsible project development in all jurisdictions where we operate in Africa.

Kenya ruling backs high standards for delivery partners

The Eldoret High Court ruling  lends validity to Earthbanc’s April 2025 decision to end GPI2050’s contract, after it fell short of agreed standards. The court made a key point: a party that fails its own obligations cannot enforce the contract.

Holding delivery partners to high standards is how we protect the farmers and investors who rely on our projects. This standard is important to uphold across all our land restoration and nature-based solutions work which continues internationally.

Co-Founders Tom Duncan, Chau Duncan and Rishabh Kahhanah, who were also named as defendants, welcomed the findings, and in May 2026 under their guidance, Earthbanc donated more than three million tree seedlings to the Kenya Forest Service for the Jaza Miti initiative.

We thank our Kenyan partners for their trust and support. We also thank the Kenyan farmers and communities who wishing to take part in Regeneration Kenya.
